Introduction

The PAIA Policy of the Joe Sibanyoni Foundation is established in accordance with South Africa’s Promotion of Access to Information Act, 2 of 2000 (PAIA). This policy facilitates the right to access information, supporting transparency and the public’s right to know, while also protecting privacy and confidentiality where applicable.

Grounds for Refusal

The Foundation may refuse access to records if:

  • Disclosure of the record would result in an unreasonable invasion of privacy.

  • Disclosure would compromise the safety, property, or operations of the Foundation.
  • The record contains privileged information protected by legal proceedings.

Decision Process and Notification

The Information Officer will assess and respond to each request within 30 calendar days:

  • Approval: If granted, access to records will be provided, subject to payment of any applicable fees.
  • Denial: If denied, the requester will receive reasons for refusal and information on how to appeal the decision.

Appeal Process

Requesters have the right to appeal a refusal decision:

  • Appeals must be submitted to the Information Regulator within 60 days of the decision.

Fees for Access

Fees are applicable as per the PAIA Fee Schedule for processing and accessing records. These may include:
